Terms of Service

Welcome to Studio Movement. 

These Terms of Service, Privacy Policy, and Participant Acknowledgment explain the policies that apply when you use our website, mobile application, booking services, memberships, class packages, private sessions, and participate in Studio Movement classes and services. 

By creating an account, purchasing a membership or class package, booking a class or private session, or participating in Studio Movement services, you acknowledge that you have reviewed and agree to the applicable terms below. 

ABOUT STUDIO MOVEMENT 

Studio Movement provides movement, fitness, Pilates-inspired, sculpt, strength, dance, cardio, wellness, mobility, recovery, and related classes and services. 

Classes and services may vary by schedule, instructor, format, and availability. 

Studio Movement reserves the right to modify its class schedule, instructors, class formats, hours, and services as reasonably necessary for business operations. 

HEALTH AND PARTICIPATION ACKNOWLEDGMENT 

Participation in physical exercise and movement activities involves physical exertion and certain inherent risks. 

By participating in a Studio Movement class, private session, event, or service, you acknowledge that you are voluntarily participating in physical activity. 

You are responsible for determining whether you are physically able to participate in a class or service. 

You agree to inform your instructor of any physical limitation, injury, pregnancy, recent surgery, or other circumstance that may affect your ability to safely participate. 

Studio Movement instructors do not provide medical advice, diagnosis, or medical treatment. 

You should consult a qualified healthcare professional before beginning or changing an exercise program if you have questions or concerns regarding your health or ability to participate. 

You agree to follow reasonable safety instructions provided by Studio Movement instructors and staff and to stop participating if you experience pain, dizziness, shortness of breath beyond normal exercise exertion, or other concerning symptoms. 

Nothing in this acknowledgment is intended to waive or limit any legal right or liability that cannot lawfully be waived under applicable New York law. 

CLASS RESERVATIONS 

Class reservations are subject to availability. 

Studio Movement classes may have limited capacity. Certain classes may be limited to approximately 15 participants or another capacity established by Studio Movement. 

A reservation is required to guarantee a Movement Spot in class. 

Customers are responsible for reviewing their reservation date, time, and class location before attending. 

CANCELLATION POLICY 

Studio Movement maintains a 12-hour rolling cancellation policy for standard group classes. 

Customers may cancel a class reservation at least 12 hours before the scheduled class start time without a late cancellation penalty. 

Cancellations made less than 12 hours before the scheduled class start time are considered late cancellations. 

For customers booking with an eligible membership, a late cancellation may result in a $15 late cancellation fee. 

Failure to attend a reserved class without cancelling is considered a no-show and may result in a $20 no-show fee for customers booking with an eligible membership. 

For customers booking with a class package or credit-based package, a late cancellation or no-show will result in the loss of the class credit used to make the reservation. 

Studio Movement may provide a courtesy waiver at its discretion. A courtesy waiver does not modify or permanently waive the cancellation policy. 

WAITLIST POLICY 

When a class reaches capacity, customers may join the waitlist. 

If a Movement Spot becomes available, eligible customers may automatically be moved from the waitlist into the class up to two hours before the scheduled class start time. 

Customers are responsible for monitoring booking notifications, email, text messages, and the Studio Movement mobile application for reservation updates. 

Within the final two hours before class, available spots may remain open for booking or may be offered through Studio Movement’s waitlist or quick-fill system. 

Joining a waitlist does not guarantee a reservation. 

MEMBERSHIPS AND RECURRING BILLING 

Certain Studio Movement memberships automatically renew according to the billing frequency and membership terms presented at the time of purchase. 

By purchasing an automatically renewing membership, you authorize the applicable recurring charges to the payment method maintained on your account, subject to the membership agreement and applicable law. 

Membership pricing, included services, booking privileges, and other membership benefits will be disclosed at the time of purchase. 

Any material changes to a membership will be communicated as required by applicable law. 

CONSUMER’S RIGHT TO CANCELLATION 

YOU MAY CANCEL YOUR CONTRACT WITHOUT PENALTY OR FURTHER OBLIGATION WITHIN THREE (3) BUSINESS DAYS FROM THE DATE YOU RECEIVE A COPY OF YOUR CONTRACT, AS PROVIDED BY APPLICABLE NEW YORK LAW. 

Additional cancellation rights may apply under New York law, including rights related to qualifying disability, death, relocation, or the availability or relocation of services. 

Membership cancellation requests may be submitted through the cancellation methods made available by Studio Movement and as required by applicable New York law. 

Studio Movement will process eligible membership cancellation requests in accordance with applicable law. 

CLASS PACKAGES AND CREDITS 

Class packages and credits are subject to the expiration date and terms disclosed at the time of purchase. 

Unused credits are not redeemable for cash except where required by law. 

Late cancellations and no-shows may result in the loss of the credit used to reserve the class. 

Class packages and credits may not be shared or transferred unless specifically permitted by Studio Movement. 

PRIVATE SESSIONS 

Private Sessions may include private movement instruction, personal training, Pilates-inspired sessions, or other specialty services offered by Studio Movement. 

Private Sessions are subject to instructor availability and the cancellation policy disclosed at the time of booking. 

Customers are responsible for providing accurate information regarding physical limitations that may affect participation. 

PAYMENT INFORMATION 

Customers are responsible for maintaining a valid payment method on their Studio Movement account. 

Applicable membership fees, package purchases, private session charges, late cancellation fees, and no-show fees may be charged to the payment method associated with the customer’s account in accordance with the applicable purchase terms. 

If a payment is declined or returned, Studio Movement may temporarily restrict booking privileges until the account balance is resolved. 

STUDIO CONDUCT 

Studio Movement is committed to creating a welcoming, respectful, and inclusive movement environment. 

Customers are expected to treat instructors, staff, and fellow participants respectfully. 

Harassment, threatening behavior, unsafe conduct, intentional disruption of a class, or conduct that materially interferes with another customer’s experience may result in removal from a class or suspension of Studio Movement privileges. 

PERSONAL BELONGINGS 

Customers are responsible for their personal belongings while visiting Studio Movement. 

Studio Movement is not responsible for lost, misplaced, or stolen personal items except to the extent responsibility is imposed by applicable law. 

PHOTOGRAPHY AND MARKETING 

Studio Movement may occasionally photograph or record classes, events, or studio activities for marketing and promotional purposes. 

Where appropriate, Studio Movement will seek consent or provide notice regarding promotional photography or recording. 

Customers who do not wish to appear in promotional photography or video should notify Studio Movement staff.
